If you step and fall on another person’s property, you absolutely have a claim against that other person, and that assumes, of course, that the person had notice of the condition, either actual notice or caused the condition himself; or constructive notice, meaning that it was there for a substantial period of time and any reason that person should have known about it. In that event, that person can be held responsible, and, generally, his homeowner’s insurance would be responsible for payment of the damages.
