How Much Time Do I Have To File My Accident Case in New Jersey?
In New Jersey, you have two years from the date of the accident to file a lawsuit for damages if you are personally injured. If the accident involves property damage, then you have up to 6 years in most cases. If a minor’s involved in the accident, then you have 2 years from when the minor reaches 18 years of age. But I would not advise anybody to wait 15 years before they file a lawsuit. In addition to this, there are cases involving public entities, boards of education, cities, counties, towns, where, yes, you have two years to file a lawsuit, but you have to notify them in a certain form by certified mail within 90 days of the date of the accident or you’re claim maybe forever barred.
