How to Determine if My Accident Case will Go To Trial In New Jersey
Whether or not your accident case will have to go to trial is a decision that’s going to be entirely made up to you. We’re going to give you our opinion before this case is concluded whether or not your case is one that should be tried. And that’s going to be based on whether or not we think that the upside potential of a verdict from one of our juries here is going to be outweighed by the downside risk of going to trial. For example, if there’s a liability issue in the case, and we think that your case bears the possibility of a loss of jury coming back with a verdict saying “no cause for action,” as versus going to trial and possibly coming out with twice with the insurance company offers in settlement, we’re going to tell you that. And it’s going to be your decision as to whether or not to go to trial, but it’s not a decision we’re going to make for you. We’re going to give you all the information you need to make that decision but, ultimately, the decision is going to be yours.
