If I Slip and Fall on a Neighbor’s Patio, Do I Have a Claim?
The criteria for determining whether or not you have a claim if you slip and fall on your neighbor’s patio is the same as if you slip and fall in anyone else’s residence. Was there a defective condition that caused you to fall, and should your neighbor have noticed it before the accident occurred? You can’t automatically expect to recover just because you had an accident on someone else’s property. Negligence has to be proven. It can be proven by determining if he didn’t do something he should have done, or he did something he should not have done, in terms of care of the premises or correcting the defective condition. If you do have a claim, his homeowner’s insurance will most likely be responsible, not him personally.
